"She killed my son and now she wants to sue me?"

A woman who killed a teenager in a car crash almost two years ago filed a lawsuit against the victim because of her depression. "I feel like I’m being played around. I’m really upset. This is getting on my nerves," said the teen's father, Derek Majewski as quoted in The Toronto Sun. In an incident which took place about 1:30 am on October 28, 2012, Brandon Majewski, 17, was cycling with two friends when he was hit by an SUV. The driver, Sharlene Simon, 42, is now suing the late Brandon and his family because she has suffering from depression since the accident. She also sued the other two teens and their families, including late Brandon’s deceased brother. Six months after the accident, Brandon’s brother , 23, died after being too depressed since the death of his brother. The family's lawyer, Brian Cameron described the lawsuit as something strange and extreme. "In my entire career as a lawyer, I have never seen anyone suing their victims," he said. Brandon’s mother is very disappointed, angry and shocked with the lawsuit. "She killed my son and now she wants to profit out of it. She says that she is suffering? Ask her to see what is in my head. She will see suffering. She will see nightmare," said Venetta Mlynczyk. Simon is seeking damages of 1.35 million Canadian dollars (about RM4 million) for "serious and permanent injuries" caused to her physical, mental and psychological state by the accident. She also alleged that the victim was careless and did not know how to ride a bike and for not using the brakes properly. Simon also accused the local authorities for failure to maintain the roads. According to police, Simon admitted driving at a speed of 90 miles per hour in the 80 mile per hour speed zone. He claimed not to see the three teenagers before his vehicle crashed into Brandon. The crash resulted in the car’s windscreen being cracked, a dented bumper and a broken headlight. The roof of the car too had dents and scratches while the side mirrors were torn off Brandon died at the hospital due to various injuries while a friend of his sustained serious injuries including a fractured hip. Another friend suffered only light scratches. Brandon's family lawyer filed a common accident damage claim on Simon for speeding, being drunk and using a mobile phone. The case has not been heard by the court.
