Selangor Menteri Besar Datuk Seri Mohamed Azmin Ali today filed an application to seek a judicial review to challenge the decision of the Auditor General to classify as official secrets the Auditor General's Report on 1Malaysia Development Berhad (1MDB).
Mohamed Azmin, who is also PKR deputy president, filed the application through Messrs Tommy Thomas at the Kuala Lumpur High Court registry here.
He named Prime Minister Datuk Seri Najib Razak, Auditor General Tan Sri Amrin Buang and the Government of Malaysia as the first, second and third respondents, respectively.
In his application, Mohamed Azmin sought a declaration that the action of the first respondent (Najib) to classify the 1MDB Report as official secrets was an action in conflict of interest.
He also sought a declaration that the classification of the 1MDB Report as official secrets by the second respondent (Amrin) was unlawful and ultra vires the Federal Constitution, the Official Secrets Act and/or the Audit Act 1957.
Azmin also sought a mandamus order to compel all the respondents, employees, officers and agents or by any means to immediately reclassify all 1MDB reports pursuant to Section 2C of the Official Secrets Act 1972 and publish it for public consumption.
He had filed the application on the grounds that the decision to classify the 1MDB Report as official secrets was unconstitutional because it went contrary to Article 107 of the Federal Constitution.
He also contended that the reluctance of the respondents to reclassify the report was unreasonable.
