Bukit Katil MP files application to set aside charge

Bukit Katil Member of Parliament Shamsul Iskandar Mohd Akin today filed an application to set aside a charge made against him for allegedly participating in a 'Blackout 505' rally held in a compound of a mosque here. The notice was filed through the legal firm of Messrs. Fahda Nur & Yusmadi at the High Court registry here. In the application, Shamsul Iskandar, 40,claimed that the charge made against him was flawed, defective and not in accordance with the requirements of a prohibited place, besides an abuse of the court process and a travesty of justice. He claimed that the charge was politically motivated, a selective prosecution , done with malicious intent and a prejudice to the sovereignty of the law. Shamsul Iskandar, who was accompanied by his counsel, Yusmadi Yusoff, requested that the charge under Section 4(2)(b) of the Peaceful Assembly Act to be set aside on grounds that the law was not constitutional and contradicted Article 10(1)(b) of the Federal Constitution. As such, Shamsul Iskandar, who is Angkatan Muda Keadilan (AMK) chief, is seeking the court to acquit and discharge him of the charge. On Aug 5, 2013, Shamsul Iskandar, AMK deputy chief Khairul Anuar Ahmad Zainuddin, 36, and its vice-chief Mohd Nazree Mohd Yunus, 29, pleaded not guilty to a charge of participating in the rally in the compound of the Ar-Rahman Mosque at Universiti Malaya here between noon and 1.15 pm on June 22. The charge provides for a maximum fine of RM20,000 upon conviction.
