Company charged with processing of personal data without PDPD certificate
The court set May 22 for mention to allow the company to appoint a lawyer and for submission of documents.
A company, which operates a private college here, was charged in the Sessions Court here today with processing the personal data of former employees of the college without a certificate of registration issued by the Personal Data Protection Department (PDPD).
Khas Cergas Sdn. Bhd , represented by its human resource manager, pleaded not guilty to the charge before Judge Harmi Thamri Mohamad @ Shaharuddin .
The company, as a data user, was charged with processing the personal data of former employees of Victoria International College user of the data who are 40 years of age, without a certificate of registration issued by PDPD.
The offence was allegedly committed at the premises of Victoria International College in Jalan Kampong Batu, Taman Batu 5, Jalan Ipoh, at about 12.15 pm on June 6, 2016.
The charge, under Section 16(4) of the Personal Data Protection Act 2010, provides a fine of up to RM500,000, or imprisonment for up to three years, or both, if found guilty.
The court set May 22 for mention to allow the company to appoint a lawyer and for submission of documents.
The prosecution was conducted by deputy public prosecutors Izalina Abdullah and Fauziah Daud, from the Communications and Multimedia Ministry.
Izalina, when met by reporters, said this was the first case to o be charged under the Personal Data Protection Act 2010.
PDPD is an agency under the Communications and Multimedia Ministry. It was established on May 16, 2011 after Parliament passed the bill on Personal Data Protection.
