Noor Hezree Mohd Arifin, 32, pleaded not guilty when the charges were read out to him before Judge Mohd Kafli Che Ali.
On the first to third counts, the accused was charged with committing unnatural sex, using criminal force with the intention to outrage the modesty and to have sexual intercourse with a 31-year-old spa worker without her consent at a spa in Bandar Seri Putra, Bangi at 12.30pm on Nov 12.
For the unnatural sexual intercourse and sexual assault offences, the man was charged under Section 377B and Section 377CA of the Penal Code which carry a maximum of 30 years in jail and whipping, if convicted.
The molestation charge falls under Section 354 of the Penal Code which provides for imprisonment of up to 10 years or fine or whipping or with any two of such punishments, upon conviction.
The father of two was also charged with robbing the woman of RM953 in cash, a necklace and an ankle bracelet using a knife at the same place, date and time under Section 392/397 of the Penal Code.
The provision carries a maximum jail term of 14 years and shall also be liable to a fine or whipping, if convicted.
Deputy public prosecutor Norhana Sahat, who prosecuted, did not offer bail for fear that the accused would intimidate the victim.
Noor Hezree who was unrepresented, appealed to the court to release him on bail, stating that he has to take care of his two children and wife.
However, the court did not allow bail for the accused and set Jan 7 next year for case mention.
Meanwhile, Noor Hezree pleaded not guilty at the Magistrate’s Court here to a charge of escaping from police custody last week.
He made the plea after the charge was read out to him before magistrate Muhammad Noor Firdaus Rosli.
The accused was alleged to have committed the offence at a treatment room of the Kajang Hospital at 11.40 am on Nov 13.
The charge under Section 224 of the Penal Code carries a jail term of up to two years or a fine, or both, upon conviction.
Muhammad Noor Firdaus allowed the accused bail of RM10,000 with two surety and ordered him to report himself at the nearest police station every month.
The court fixed Jan 7 next year for mention of the case.
