Court jails jobless man four months for choking, insulting police

PETALING JAYA:An unemployed man who choked a policeman and hurled expletives at him was jailed four months by the Magistrate’s Court, here, today.
Majistrate Mohamed Ikhwan Mohd Nasir meted out the punishment on Ahmad Rosli Ahmad Kamsah, 49, after he pleaded guilty to the two charges.
Mohamed Ikhwan imposed a four-month jail for each of the charges and ordered them to run concurrently from the date of arrest on Nov 11.
Under the first charge, the man was indicted with using criminal force to frighten Corporal Mohamed Nor Fitri Zainurin by choking his throat under Section 353 of the Penal Code which provided jail of up to two years or both if guilty.
Under the second charge, the father of one was accused of deliberately undermining the decency of the same victim by repeatedly unleashing harsh words under Section 509 of the Penal Code which provided a maximum five-year jail or fine or both.
Ahmad Rosli was charged with committing the two offences at a house in Impian Baiduri, here, at 5.05 pm, on Nov 11.
Based on the facts of the case, on the day of the incident, the victim who was a policeman from the patrol division had received information that a man had run amok and assaulted his wife and daughter.
Upon his arrival at the scene, the victim tried to calm the accused but the accused had uttered harsh words and inflicted injury on him by choking him.
In mitigation, the accused, who was not represented by a counsel, appealed for a light sentence by saying that he was jobless and had to support his wife and daughter.
But Deputy Public Prosecutor, Hakim Amir Abdul Hamid urged the court to impose a deterrent sentence as a lesson to the accused.
Meanwhile, at a different Magistrate’s Court, Ahmad Rosli pleaded not guilty to two charges of assaulting his wife and 11-year-old daughter.
Under the two charges, the man was indicted with deliberately causing hurt to his wife and daughter by hitting them at 4 pm at the same place and date under Section 323 of the Penal Code which was read with Section 326A of the Penal Code which allocates a maximum two-year jail if convicted.
Prior to that, the accused had pleaded guilty but reversed it after the court stood down for a while to decide on the cases.
During the proceeding, before the accused changed his plea, he apologised to his wife from the dock and cried. His wife who sat at the public gallery went close to him and was also seen crying.
It is understood, the accused changed his plea after discussing with his wife who wanted to withdraw the report on the case.
The prosecution was handled by Zamriah Zarifah Aris while the accused was not represented. Magistrate Muhammad Iskandar Zainol fixed Jan 19 for remention of the case.
