The Sessions Court here today ordered PLUS Malaysia Berhad (PLUS) to pay damages amounting to RM158,961.61 to the wife of an Election Commission officer who died in an accident at Kilometre 342.6 North-South Expressway near Tapah, two years ago.
In the incident on April 29, 2015, Imran Kamili Ahmad Nazirin, 45, was returning to his office in Putrajaya on his Harley Davidson motorcycle when he hit a wooden block in the middle of the road.
Judge D. Sunita Kaur Jessy in chambers ruled that PLUS was 100 per cent responsible for failing to ensure that the road under its management was in safe condition for consumers.
PLUS was represented by counsel Siti Aimuni Abd Latif while lawyer Sukhdave Singh represented the victim's wife, Hawa Liyana Hashim, 34, who was also present in court.
Sukhdave told reporters when met that the RM158,961.61 also included RM3,000 for funeral expenses.
Meanwhile, Hawa Liyana was thankful and satisfied with the court's decision, describing it as a 'Ramadan gift'. She plans to use the money to repair the motorcycle that her late husband rode in the incident.
"However, I will discuss the matter with my late husband's two other children, whether to repair, keep or sell the motorcycle," she said.
Hawa Liyana was five months pregnant when the tragedy happened. She and Imran Kamili had two children aged eight years and one year nine months.
Imran Kamili had two other children aged 18 and 16 years from a previous marriage.
