Former police officer acquitted and discharged of robbery
A former police officer (ASP) who was accused of allegedly robbing two men, four years ago, was freed and discharged by the Sessions Court here today.
Judge Mohamad Sekeri Mamat made the decision after the prosecution failed to establish a prima facie case against Che Anua Che Omar, 57, who was accused, together with another person still at large, of robbing Ahmad Shabri Mohd Halami.
Sekeri in his judgement said the prosecution did not produce the receipt for the withdrawal of cash from Bank Simpanan Nasional (BSN) as claimed by Ahmad Shabri who is the first witness.
"Furthermore, there was no evidence to show that the cash and jewellery of the first witness was robbed by the accused, or the cash that belonged to the second prosecution witness Kamal Ariffin Hashim was withdrawn by Ahmad Shabri from the bank," he said.
Che Anua from Sri Gombak, Selangor, was accused, together with another person still at large, of robbing Ahmad Shabri Mohd Halami, 29, of cash, jewellery and a handphone, worth a total of RM10,000, at No. 44-3 Rampai Court, Blok B, Wangsa Maju, Sentul here at 9pm on May 5, 2009.
He was charged under section 395 of the Penal Code which provides for jail up to 20 years and whipping, if convicted.
The prosecution was led by Deputy Public Prosecutor Norasyikin Ahmad while Che Anua was represented by Nik Mohamed Ikhwan Nik Mahamud.
