Former UMNO Batu Kawan deputy chairman, Datuk Seri Khairuddin Abu Hassan has decided to withdraw the habeas corpus petition filed at the High Court today.
His lawyer Haniff Khatri Abdulla said the decision was made because the application is no longer relevant and has become 'academic'.
"The application made was to challenge the arrest notice issued on September 23," said Haniff to Astro AWANI through WhatsApp service.
However, he added that the situation is different now as his client is not in the Dang Wangi police station but at the Sungai Buloh prison.
High Court judge Kamardin Hashim allowed the retraction of the application.
Prior to this, Khairuddin has been remanded for six days from 19 September under Section 124C of the Penal Code on charges of attempts deemed detrimental to parliamentary democracy.
On September 23, Khairuddin was arrested again in Jalan Duta Court Complex under Sosma on charges of attempting to carry out activities that could sabotage the country.
Meanwhile, Matthias was arrested on Oct 8 after visiting his client at the Dang Wangi police station.
