'Kidex agreement involves Federal Government, not State'
Faekah reportedly says the Selangor Government has no right to cancel the Kidex project as the agreement signed was only between the Federal Government and the concessionaire.
Kidex Sdn Bhd (KSB) is currently awaiting feedback from the Federal Government, following the cancellation of the Kinrara-Damansara Expressway (Kidex) project by Selangor State government today.
KSB CEO, Datuk Mohd Nor Idrus said it was necessary to do so as parties involved to the Concession Agreement (CA) signed in November 2013, are the Government of Malaysia and KSB.
"We are now awaiting feedback from the Government as it is a party to the agreement.
"Meanwhile, we will continue with our engagements with the State Government," he said in a statement today.
Mohd Nor said the Conditions Precedent (CP) Period, as defined in the CA, had been extended for a further period of nine months commencing from Feb 15, 2015 and expiring on Nov 14 this year.
Earlier today, Selangor Menteri Besar Mohamed Azmin Ali had cancelled the controversial Kidex project.
In a statement, Mohamed Azmin said this was because the project concessionaire had failed to meet the conditions set by the state government.
He had said the state had informed Kidex to adhere to the conditions before Feb 14, 2015.
However, in a The Star Online report today, former Mentri Besar Incorporated (MBI) CEO Faekah Hussin had ruled out the Selangor Government's power to cancel Kidex.
The state government has no authority to cancel the project as the deal was struck between the Federal Government and the concessionaire, the report quoted her as saying.
According to the report, Faekah said the state government was only tasked with providing the land and had no involvement in the deal.
She also said by announcing the cancellation of the deal, the Pakatan Rakyat-led Selangor was opening itself to legal suits.
