Transport Minister Datuk Seri Liow Tiong Lai said the case of Kuala Kubu Bharu train collision earlier this month has been handed to the police for criminal investigation.
He also confirmed that the incident was caused by the driver's negligence.
"I have received the train accident report and it is confirmed that its the driver's negligence," he told reporters today.
"We also refer this case to the police for criminal investigation because we take this very seriously," he added.
He said disciplinary action had been taken against the driver who has been suspended following the incident on May 7.
Liow said the driver had override the automatic protection system in place.
"This is uncalled for. We have taken action, we have suspended him and we have taken the action. At the same time we also want to refer this case for criminal investigation. The police are looking into this case now," he added.
On May 7, three passengers were slightly injured when the Ekspres Rakyat train from Butterworth to Johor Bahru brushed against the Electric Train Service (ETS) train heading from Kuala Lumpur to Ipoh at 1.45pm.
