KUALA LUMPUR: The High Court here today granted permission to Datuk Seri Najib Tun Razak to issue third-party notices against six former directors of SRC International Sdn Bhd in the US$1.18 billion lawsuit filed by the company against him.
The six individuals are Datuk Suboh Md Yassin, Nik Faisal Ariff Kamil, Datuk Mohammed Azhar Osman Khairuddin, Datuk Shahrol Azral Ibrahim Halmi, Tan Sri Ismee Ismail and Datuk Che Abdullah @ Rashidi Che Omar.
SRC previously removed the six individuals from the suit and only retained Najib as the sole defendant.
Judge Datuk Ahmad Fairuz Zainol Abidin granted the leave following the application from Najib's counsel, Harvinderjit Singh with no objection from lawyer A.Thenesh on behalf of SRC.
The court ordered that the notices be delivered to the relevant individuals within 14 days after they are filed.
Harvinderjit said his team would file the notices next week.
SRC as the plaintiff alleged that Najib, who was SRC's Emeritus Advisor from May 1, 2012, to March 4, 2019, had abused his power and obtained personal benefits from the company's funds as well as misappropriated the funds.
SRC, which is now wholly owned by the Ministry of Finance Incorporated is seeking general, exemplary and additional damages as well as interests, costs and other appropriate reliefs deemed fit by the court.
Najib, 69, is serving 12 years in jail after the Federal Court, in Aug this year, upheld his conviction and jail sentence and RM210 million fine for misappropriating RM42 million in SRC International funds.
