The Kuantan High Court has fixed February 27 for re-mention of the case on the head of the 'Tuhan Harun' deviationist teaching group, Harun Mat Saat together with three of his followers who were charged with the murder of the Principal Assistant Director of the Pahang Islamic Religious Department (Jaip), Ahmad Raffli Abd Malek.
Justice Datuk Ab Karim Ab Rahman fixed the date after Deputy Public Prosecutor, Khamizah Salleh, submitted an application to the court to merge the two cases to be heard simultaneously, that is, the murder case and the conspiracy to commit murder.
Counsel Hermes Media Putra Ibrahim, representing all the accused, namely Harun, 47, his wife, Azida Mohd Zol, 30, and followers, Sumustapha Suradi, 39, and Shaizral Eddie Nizam Shaari, 37, however asked the prosecution to submit all relevant documents to him to facilitate preparation of the defence case.
On December 16, Sumustapha, who hails from Sabah, had pleaded not guilty to the murder of Ahmad Raffli, 49, in front of the victim's house at Lorong IM2/29, Bandar Indera Mahkota, here at 1.50pm on November 10 together with two others who are still at large.
The charge is made under Section 302 of the Penal Code which carries the mandatory death sentence upon conviction.
Harun, Azida and Shaizral Eddie Nizam also pleaded not guilty to the charge of conspiring together with Sumustapha and two others still at large to commit criminal conspiracy which led to the killing of Ahmad Raffli.
The offence was alleged to have been carried out at the same time and place which went against Secton 302 of the Penal Code.
All the accused were charged under Section 120B (1) and read together with Section 34 of the same code which provided for the mandatory death sentence.
