A security guard and his son were charged in two separate Sessions Court in Ampang here on Friday with raping his daughter, who is also his son's own sibling, five years ago.
The 44-year-old man allegedly committed the offence in an apartment in Ampang between 2012 and 2014, when the victim was between 10 and 12 years old. His son aged 19, who is the victim's own brother, allegedly committed the offence at the same place in December 2015, when she was 13 years old.
The two accused face Section 376 (3) of the Penal Code which provides for a maximum 30-year jail term and not less than 10 strokes of the cane if found guilty.
Deputy public prosecutor Ahmad Zuhaini Mahamad Amin and Nadiah Malek Fauzie did not propose bail as the offence is non-bailable.
"No bail is proposed considering that the victim is the accused's own daughter. The victim was also raped by her own brother. I fear they might harass the victim," submitted the DPPs. They also informed the court that the victim was being treated at a hospital.
Both the accused, who were unrepresented, asked for bail as the father had to support a wife and six children including the victim and four stepchildren.
However, both judge Syafeera Mohd Said and judge Azrul Darus did not grant bail and fixed Oct 16 for re-mention.
It is learnt the victim, who is now 15, stayed with her father and brother since she was seven years old after her parents separated.
Her father remarried in 2016, and the victim left school after Form One. She currently worked as an eatery assistant and stays with her mother.
Earlier, before the proceeding started, the security guard who was in the dock, was seen sobbing and being comforted by his mother, wife and sister while his son appeared nonchalant.
