A teacher and her lover, a Pakistani, were charged at the Magistrate's Court here Friday with making a pornographic film last month.
The accused, Lizah Buang, 49, and Muhamad Usman Ali Liqat, 27, however, pleaded not guilty despite nodding when the charges were read out to them by magistrate Mohd Firdaus Saleh.
According to the facts of the case, the duo was jointly charged with making an obscene film or recording that went against public decency.
The offence was allegedly committed at an apartment unit at Bukit Beruang Utama Apartments here in Malacca at 8.30am on Nov 16, 2013.
If convicted under Section 5(1)(b) of the Film Censorship Act 2002, read together with Section 34 of the Penal Code, the duo shall be liable to a fine of not less than RM10,000 and not more than RM50,000 or to imprisonment for a term not exceeding five years, or to both.
Earlier, deputy public prosecutor Norshazwani Ishak applied to the court to grant Lizah a RM3,000 bail but deny bail for Muhamad Usman who was a foreigner.
Lizah, however, pleaded to have her bail reduced, claiming that she has to care for a sick and unemployed husband as well as six children.
Mohd Firdaus then granted her a RM2,500 bail while Muhamad Usman’s bail was set at RM10,000 in two sureties with the latter also having to report himself to the nearest police station once a month.
