Palanivel, three others file for judicial review to quash directive by ROS

MIC president Datuk Seri G. Palanivel and three others have filed for a judicial review to quash the Registrar of Societies (ROS) directive calling for fresh election of several key party posts.

Palanivel, former MIC secretary-general A. Prakash Rao and MIC vice-presidents Datuk S. Sothinanthan and Datuk S. Balakrishnan filed the application on Feb 24 at the High Court (Appellate and Special Powers) registry via the law firm Arbain & Co.

The ROS and the minister of home affairs were named as the first and the second respondents.

The High Court set March 9 to hear the application before Judge Datuk Asmabi Mohamad.

The four sought a certiorary order to overturn the ROS directive via letters dated Dec 5 and Dec 31, 2014 and Feb 6 and wanted a declaration that the letters and directives were wrong in law, invalid, void and of no legal effect. They also sought a declaration that the directives were not in accordance with the Federal Constitution and against Article 10(1)(c) of the Federal Constitution and the MIC Constitution.

The applicants also sought a declaration that the results of the MIC Annual General Meeting held on Nov 30, 2013 were valid and effective and to suspend the ROS directive pending the judicial review.

They also sought a temporary injunction to prevent the respondents from taking action against the MIC nor issue any directive to the party until the judicial review is completed.
