'UMNO's decision to suspend Muhyiddin cannot be challenged in court'
KU NAN: Muhyiddin was not dismissed, he was suspended. The clause he cited has nothing to do with his suspension.
The UMNO Supreme Council's decision to suspend Tan Sri Muhyiddin Yassin from his party deputy president post cannot be challenged in court, Datuk Seri Tengku Adnan Tengku Mansor said.
The UMNO secretary-general said this is stated under Section 18C of the Societies Act 1966.
Tengku Adnan also denied Muhyiddin's allegation that the Supreme Council had breached the party constitution in their decision to suspend him.
Earlier, Muhyiddin had told reporters that the council had breached Clause 9.12 of the constitution by not referring him to the party disciplinary board before suspending him.
In clarifying this, Tengku Adnan said Clause 9.12 had nothing to do with suspension.
"Clause 9.12 of the UMNO Constitution relates to the dismissal of any Supreme Council member from their position.
"Muhyiddin was not dismissed but suspended. The said clause is unrelated to his case," he said in a statement today.
He said Muhyiddin's suspension was carried out under the Supreme Council's existing and residual powers, under Clause 10.15, for the betterment of the party.
On Feb 26, UMNO suspended Muhyiddin from his deputy president post with immediate effect until the next party elections in 2018.
Muhyiddin, in a special conference earlier today, said he would seek an explanation from the Registrar of Societies (RoS) if his suspension was valid.
