In the MACC investigation, the Ministry of Finance confirmed that it does not have records of both letters.
According to Senior Officer Nur Aida Arifin when questioned by defense counsel Wan Azwan Aiman Wan Fakhruddin during cross-examination, she agreed with the defense's suggestion that Datuk Seri Najib signed the letters in his capacity as Minister of Finance in accordance with Section 6 of the Companies Act 1965.
The witness also agreed with the suggestion that Datuk Seri Najib signed the Special Right Redeemable Preference Shareholder Resolution and Minutes By Representatives dated February 9, 2012, and August 10, 2012, in his capacity as Minister of Finance in accordance with section 132(1) of the Companies Act 1965 and article 6(3) of the Memorandum & Article of 1MDB.
Both documents were signed by Datuk Seri Najib for 1MDB to take over both entities in addition to approving the financing of the takeover, which included local bank loans and bond issuance.
Nur Aida stated so as the 49th prosecution witness in the trial involving corruption and money laundering charges involving RM2.3 billion of 1MDB funds faced by Datuk Seri Najib Razak.
The trial before Judge Datuk Collin Lawrence Sequerah continues tomorrow.
