KUALA LUMPUR: The trial of prominent businessman Datuk SM Faisal SM Nasimuddin, who is charged with injuring his ex-wife Emilia Hanafi, that was scheduled today at the Magistrate's Court here has been postponed to Nov 25.
SM Faisal's lawyer, Datuk Jagjit Singh told the court that the lead counsel for the businessman, Datuk Akberdin Abdul Kader was unable to attend today because he was having respiratory problems and submitted the lawyer's medical certificate (MC) to the court.
"Datuk Akberdin was scheduled to question the prosecution's sixth witness, Elisa Nani Hanafi, who was called to give her statement today. However, I humbly request the court for the case today to be postponed," said Jagjit before Magistrate Nadia Othman.
Earlier, Deputy Public Prosecutor, Zahida Zakaria said the prosecution was prepared to hear the testimony of Elisa Nani, the sister of Emilia, today.
"The prosecution has submitted a copy of Elisa Nani's statement to the defence on Oct 30 (yesterday)," said Zahida.
Jagjit confirmed that the defence had received a copy of the witness's statement.
SM Faisal, 43, was charged with intentionally causing injury to Emilia, 43, who was his wife at the time of the incident at a house in Desa Sri Hartamas here between 12.30 pm and 4.30 pm on Nov 22, 2015.
He was charged under Section 323 of the Penal Code and can be punished under Section 326A of the same law which carries a maximum prison sentence of two years or a fine of up to RM2,000 or both, upon conviction.
