KUALA LUMPUR:A Member of Parliament from Pakatan Harapan (PH) has suggested that Prime Minister Tan Sri Muhyiddin Yassin immediately seek an audience with the Yang di-Pertuan Agong Al-Sultan Abdullah Ri'ayatuddin Al-Mustafa Billah Shah due to the loss of majority support.
Pasir Gudang Member of Parliament, Hassan Abdul Karim, claimed that the Perikatan Nasional (PN) government can now be considered to have fallen after Machang Member of Parliament, Datuk Ahmad Jazlan Yaakub, withdrew his support for the coalition.
"Based on Article 46 of the Federal Constitution, there are 222 members of the Dewan Rakyat. Two MPs have passed away, namely the MP for Batu Sapi in Sabah and the MP for Gerik in Perak.
"This brings the total number of members of the Dewan Rakyat for the 14th Parliament to 220. The Pagoh Member of Parliament has the support of only 110 now, making the Prime Minister and the PN government led by him no longer has majority," he said in a statement on Sunday.
Hassan said, on March 1, 2020, the Yang di-Pertuan Agong appointed Muhyiddin as Prime Minister based on Article 43 (2) (a) of the Federal Constitution, which in the opinion of His Majesty, the Pagoh Member of Parliament gained the confidence of the majority of Dewan Rakyat members.
"Now the MP for Machang has withdrawn his support for Muhyiddin and also the PN government. In this situation, it is better for us to refer to the Federal Constitution again. Article 43 (4) of the Federal Constitution states as follows:
"If the Prime Minister no longer has the confidence of the majority of the members of the Dewan Rakyat, then the Prime Minister must resign from the Cabinet unless at his request Parliament is dissolved by the Yang di-Pertuan Agong," he said.
Hassan said that during Muhyiddin's 10 months as Prime Minister, he had avoided and denied the presentation of the motion of no-confidence against him as Prime Minister in Parliament and even the motion of no-confidence against him as Prime Minister brought by government MPs was not given a chance to be tabled.
"The provisions of the Federal Constitution are clear. So I, as one of the members of the Dewan Rakyat, call on the Prime Minister to abide by the Federal Constitution, which is to immediately seek consent to have an audience with the Yang di-Pertuan Agong as soon as possible.
"The Pagoh Member of Parliament while taking the oath as Prime Minister has vowed to defend the Federal Constitution. This is the time to prove the pledge and oath of office," he said.
On Saturday, Ahmad Jazlan from Barisan Nasional (BN) announced to withdraw support for Muhyiddin as Prime Minister.
Apart from that, Padang Rengas Member of Parliament, Datuk Seri Mohamed Nazri Abdul Aziz claimed that more UMNO MPs were expected to follow in the footsteps of Ahmad Jazlan and withdraw support for the government.
